La conférence ministérielle d'Interlaken, des 18 et 19 février 2010, a été l'occasion d'adopter une déclaration commune qui accompagnera la réforme de la Cour initiée par la signature le 12 mai 2004 du protocole n° 14 qui entrera en vigueur au 1er juin 2010 (V. Dalloz actualité, 23 févr. 2010, obs. LavricDocument Actualité). Cette déclaration commune prévoit d'atteindre un équilibre entre les nouvelles requêtes et les cas traités et de réduire le nombre des affaires en instance devant la Cour (actuellement, 120 000 environ). Il s'agit également de garantir une meilleure exécution des arrêts de la Cour par les États membres et d'assurer que cette exécution soit contrôlée par le comité des ministres du Conseil de l'Europe.&lt;br /&gt;&lt;br /&gt;Pour atteindre ces objectifs, la déclaration commune est assortie d'un plan d'action qui définit une série de mesures à court et moyen terme et fixe un calendrier pour leur mise en œuvre. Le comité des ministres est invité à évaluer, durant les années 2012 à 2015, dans quelle mesure la mise en œuvre du protocole n° 14 et du plan d'action aura amélioré la situation de la Cour. À cette occasion, il est revenu, comme c'est l'usage, sur le bilan de l'année écoulée ; il a également annoncé ce que serait, pour la Cour, l'année 2010, « année particulière » qui marque le soixantième anniversaire de la Convention.&lt;br /&gt;&lt;br /&gt;Le président de la Cour européenne juge le bilan de l'année 2009 positif, spécialement au regard de celui des années passées, en soulignant deux avancées majeures qui se sont concrétisées : l'adoption du protocole additionnel n° 14 (adoption d'un protocole 14 bis en mai 2009 ; Dalloz actualité, 5 mai , 9 juin et 9 nov. 2009 ; vote et ratification du protocole 14 par la fédération de Russie, en janv. 2010) et l'entrée en vigueur du Traité de Lisbonne (qui fait adhérer l'Union européenne à la Convention européenne et dote la Charte des droits fondamentaux de l'Union européenne d'une force juridique contraignante).&lt;br /&gt;&lt;br /&gt;S'agissant de l'activité juridictionnelle, le président a indiqué que le nombre de décisions rendues avait augmenté de 11 % en 2009 (et de 27 % pour les arrêts proprement dits ; 18 arrêts pour la grande chambre). Il a rappelé que des arrêts importants avaient été rendus en matière de garde à vue, d'analyse d'empreintes génétiques, de droit à pension de retraite en fonction de la nationalité, de régimes spéciaux de détention, de disparitions de personnes lors de conflits, d'immunités parlementaires ou de droit de concourir à des élections. Se félicitant du travail accompli, il a néanmoins souligné que subsistaient des zones d'ombre (« concerns ») non négligeables : du fossé séparant le nombre de requêtes « entrantes » de celui des décisions rendues (57 000 nouvelles requêtes ont été présentées en 2009, soit 22 000 supplémentaires par rapport à 2008, ce qui a représenté 1 800 nouvelles affaires par mois, pour 120 000 affaires pendantes en fin de l'année) à l'exécution défaillante des arrêts par les États. Soulignant la situation paradoxale dans laquelle se trouve la Cour, qui rejette actuellement 90 % des requêtes qui lui parviennent, mais après un examen complet, il a rappelé que le droit de recours individuel ne pouvait combler toutes les espérances et que la Cour ne pouvait se substituer aux engagements étatiques.&lt;br /&gt;&lt;br /&gt;Pour finir, Jean-Paul Costa a évoqué quelques-uns des axes de la conférence sur l'avenir de la Cour européenne des droits de l'homme, qui se déroulera à Interlaken les 18 et 19 février prochains : réaffirmation du droit à recours individuel et régulation de l'augmentation du nombre de requêtes nouvelles, développement des mécanismes existant en matière de règlement des litiges, prévention du contentieux et meilleure exécution des arrêts, développement du rôle consultatif de la Cour. Au-delà des réformes statutaires et structurelles qui devraient être entreprises, la conférence sera l'occasion d'un retour aux « fondamentaux », c'est-à-dire aux obligations des États issues du pacte fondateur que représente la Convention européenne (lesquelles comprennent non seulement la garantie des droits énoncés, la mise en place de recours effectifs, l'instauration de systèmes judiciaires transparents, impartiaux, équitables et raisonnablement rapides mais encore « l'obligation de se conformer aux arrêts de la Cour, au minimum lorsque les États sont parties, et de plus en plus lorsque des arrêts identifient, pour d'autres États, des problèmes ou des dysfonctionnements analogues »).&lt;br /&gt;&lt;br /&gt;L'audience solennelle de rentrée avait pour invité d'honneur Jean-Marc Sauvé, vice-président du Conseil d'État français depuis 2006. M&amp;eacute;rat, Honorary President of Interjurist&lt;/span&gt;&lt;span style="font:11px &amp;#39;Lucida Grande&amp;#39;, LucidaGrande, Verdana, sans-serif; "&gt;, for the following NGO's : &lt;br /&gt;&lt;br /&gt;International Association of Democratic Lawyers, &lt;br /&gt;Union des Juristes Arabes,&lt;br /&gt;Ligue pour les Droits de l'Homme,&lt;br /&gt;Mouvement contre le Racisme et pour l'Amiti&amp;eacute; entre les peuples,&lt;br /&gt;General Arab Women Federation.&lt;br /&gt;&lt;br /&gt;Mr. Chairman,&lt;br /&gt;&lt;br /&gt;The Commission's work is drawing to a close and we come to item 17 on the agenda which mainly concerns the protection of Human Rights.&lt;br /&gt;This Commission's work cannot be finalised without taking a clear position in regard to serious and indisputable violations of International Law, and by the same token, the rights of the victims of those violations. &lt;br /&gt;A- The first case, where the Commission should take a clear stand, is that of several hundred prisoners, held for some years in Guantanamo, Cuba.&lt;br /&gt;The fact that the war in Afghanistan was led by an international coalition, with the Security Coucil's approval, is not disputed. &lt;br /&gt;On the other hand, the prisoners of whom we speak, were apprehended during this conflict, flown thousands of miles away, to be detained and imprisonned in Guantanamo. International opinion has been moved, and rightly so, by this fact which constitutes an indisputable violation of International Law relative to prisoners of war. &lt;br /&gt;Those responsible for this transportation of prisoners to a foreign land have replied, surprisingly, that these are not prisoners of war. Public opinion, disconcerted by this statement, then asked that the crimes imputed should be clearly announced and followed up, according to the laws of the countries detaining them, giving them the right to know the facts, to dispose of legal assistance, to appear before a jurisdiction worthy of the name and to be presumed innocent. &lt;br /&gt;Those responsible for this imprisonment have replied that these prisoners cannot be tried according to the laws of the detainers, because these people are not actually on the territory of the country in question. &lt;br /&gt;&lt;br /&gt;The summing up of these &amp;ldquo;arguments&amp;rdquo; is clear : these people have been detained for several years without justice, without rights, without recourse.&lt;br /&gt;&lt;br /&gt;The Commission cannot finish its work without bringing to light this serious violation of International Law. Let us note, finally, that according to the International Red Cross, it appears that the conditions in which they are detained are frequently inhuman, and that there have been cases of torture. &lt;br /&gt;B- We must bring to the attention of the Commission to the case of Iraqi prisoners of war. Indeed this conflict came about without the approval of the Security Council, and constitutes a conflict in opposition with the United Nations Charter. &lt;br /&gt;Mr. Kofi Annan declared in September 2004 that the coalition's attack against Iraq was illegal. Furthermore, the present detention of thousands of prisoners of war or political prisoners, without trial or indictment, also constitutes a serious violation of International Law and of Human Rights. It should be stopped. &lt;br /&gt;C- Finally, we wish to bring the attention of the Commission to a special case, particularly serious : the case of Mr. Abdul Jabbar Al Kubaysi. &lt;br /&gt;This man, far from being supportive of the former regime, was living in exile in France since 1995 with his wife and children. He returned to his homeland, where he created, and managed a daily paper. Non compatibility of national rules with EEC Laws. On the grounds of the jurisprudence developed for equality of treatment between men and women within the Community, the Court, in the above said case, decided that the national judge is entitled not to implement national rules when they discriminate part of the citizens, regarding the general Tax Law regime, thus infringing Community Law (Art. 48, EEC Treaty). La Licensing Authority disait avoir respect&amp;eacute;, ce faisant, les dispositions de l'Article 11 de la directive 65/65/CEE du Conseil (26/1/65) qui autorise tout Etat-Membre &amp;agrave; retirer de son March&amp;eacute; National une sp&amp;eacute;cialit&amp;eacute; pharmaceutique qui s'av&amp;egrave;re " nocive dans des conditions normales d'emploi". Un meurtre familial, commis par une personne consommatrice de ce m&amp;eacute;dicament hypnotique, est &amp;agrave; l'origine de la d&amp;eacute;cision de la Licensing Authority. &lt;/span&gt;&lt;span style="font:10px &amp;#39;Lucida Grande&amp;#39;, LucidaGrande, Verdana, sans-serif; "&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font:10px Arial, Verdana, Helvetica, sans-serif; "&gt;La Soci&amp;eacute;t&amp;eacute; Upjohn Ltd, devant les tribunaux nationaux, avan&amp;ccedil;a qu'un contr&amp;ocirc;le juridictionnel de la d&amp;eacute;cision de retrait &amp;eacute;tait n&amp;eacute;cessaire, selon le Droit Communautaire, permettant au juge national de v&amp;eacute;rifier, en Droit, comme en fait, l'ad&amp;eacute;quation de la d&amp;eacute;cision prise par les autorit&amp;eacute;s aptes &amp;agrave; d&amp;eacute;livrer les autorisations de mise sur le march&amp;eacute;. Le principe d'effectivit&amp;eacute; ne n&amp;eacute;cessitait pas que l'avis technique d'autorit&amp;eacute;s comp&amp;eacute;tentes soit remplac&amp;eacute; par l'appr&amp;eacute;ciation des faits par les tribunaux. Cet avis technique ne peut &amp;ecirc;tre soumis qu'&amp;agrave; un contr&amp;ocirc;le de l&amp;eacute;galit&amp;eacute; restreint. La Cour conclut alors que le juge national n'a pas &amp;agrave; effectuer un contr&amp;ocirc;le plus approfondi que celui qu'effectuerait la CJCE elle-m&amp;ecirc;me. The Licensing Authority said it had applied the contents of Article 11 Directive 65/65/CEE of the European Council (26.1.65) which allows every Member State to remove from its national market a pharmaceutical product when proved "&amp;nbsp;dangerous in normal use&amp;nbsp;". A murder within a family, committed by a consumer of that hypnotic medicine, was the ground for the licensing authority 's decision. &lt;/span&gt;&lt;span style="font:10px &amp;#39;Lucida Grande&amp;#39;, LucidaGrande, Verdana, sans-serif; "&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font:10px Arial, Verdana, Helvetica, sans-serif; "&gt;The Upjohn Company LTD, pretended, before national Courts, that a legal control of the said decision was necessary, according to EEC Laws. This procedure should allow the national judge to check laws and facts, and decide if the authorities delivering authorisations for sale took the right decision. Their unique control could be in opposition with the rights accorded by EEC laws. &lt;/span&gt;&lt;span style="font:10px &amp;#39;Lucida Grande&amp;#39;, LucidaGrande, Verdana, sans-serif; "&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font:10px Arial, Verdana, Helvetica, sans-serif; "&gt;The European Court of Justice gave its opinion on the procedure followed to remove the medicine from the British market. &lt;/span&gt;&lt;span style="font:10px &amp;#39;Lucida Grande&amp;#39;, LucidaGrande, Verdana, sans-serif; "&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font:10px Arial, Verdana, Helvetica, sans-serif; "&gt;The Court enhanced that an appeal procedure was existing against such decisions in every Member State (Article 12, cited Directive). The principle of effectiveness did not imply that the technical judgement of competent authority be replaced by the Court appreciation of facts. This technical advice could only be submitted to a limited control on its legal nature. The Court settled that the national judge was not bound by conducting a control more extended than the one the ECJ would do.
